9. THE OWNER’S RIGHT TO CANCEL

9.1The Owner may have to cancel a Booking prior to the Check-in time due to an event outside their control (such as fire, flood, failure of utilities, or legislation) or if the Property will be unavailable as a result of a sale. We will contact you as soon as possible to let you know if this happens. We will try to arrange alternative accommodation in a property in our portfolio of similar facilities and price. If this is not possible, you will be entitled to a full refund. This does not apply if you cancel because you are unable to travel or stay at the property due to the COVID-19 pandemic or other legal requirements affecting you; it only applies if the Owner cancels because they are not permitted to have guests at the Property.

9.2Clause 9.1 states your sole and exclusive rights and remedies, and the Owner’s and our entire obligations and liability, if cancellation occurs under clause 9.1.

10. LIABILITY

10.1Neither we nor the Owner’s liability is limited for:
(a) death or personal injury caused by our or the Owner’s negligence;
(b) fraud or fraudulent misrepresentation; or
(c) breach of the terms implied by the Consumer Rights Act 2015.

10.2This clause outlines the responsibilities of both the company and the owner in the event of a breach of the terms and conditions. If either party fails to comply with the terms and conditions, they will be held responsible for any foreseeable loss or damage suffered by the customer as a result of the breach or negligence. However, if the loss or damage is not foreseeable, neither party will be held responsible. Loss or damage is considered foreseeable if it was an obvious consequence of the breach or if it was discussed when the booking was made.

10.3This clause states that the company and the owner are not responsible for any transportation or alternative accommodation costs incurred by the customer, nor are they responsible for any loss or damage to the customer’s belongings, items or vehicles.

10.4This clause clarifies that if the customer suffers any loss or damage as a result of a breach of the terms and conditions by the owner, the company will not be held liable. Likewise, if the customer suffers any loss or damage as a result of a breach of the terms and conditions by the company, the owner will not be held liable.

11.1This clause indicates that the company will only use the customer’s personal information in accordance with their Privacy Policy.

11.2This clause specifies that the company will only send marketing materials to customers who have explicitly stated that they wish to receive them.

12.1This clause acknowledges that the owner has the right to enforce the terms and conditions against the customer.

12.2This clause states that no other person or entity besides the customer, the company, and the owner has the right to enforce any of the terms and conditions.

12.3This clause specifies that these terms and conditions will be governed by English law, and any disputes will be resolved in the courts of England and Wales, which have exclusive jurisdiction.
